Participant Release of Liability
July 7 – July 10, 2023
**Read Before Signing** 

In consideration of being allowed to participate in any way in the “Dance Out Loud” program, related events and activities, the undersigned acknowledges, appreciates, and agrees that: 

1. I understand that the City In Motion Dance Weekend and Dance Out Loud is organized by City in Motion. 

2. The risk of injury from the activities involved in these programs is significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury to me does exist; and, 

3. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation; and, 

4. I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual significant concern in my readiness for participation and bring such to the attention of the nearest official immediately; and,

5. I, for myself and on behalf of my/our heirs, assigns, personal representatives and next of kin, hereby release the CITY IN MOTION, BAY AREA MICRO FUSION, ATHLETIC PLAYGROUND, A&W INDUSTRIES, OMNI STUDIOS, OMNI COMMONS, TRILLIANT STUDIOS, its officers, officials, agents, and/or employees, or other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of the premises used to conduct the event (“Releasees”), with respect to any and all injury, disability, death, or loss or damage to person or property incident to my involvement or participation in these programs whether  arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law. 

6. I, for myself, and on behalf of my/our heirs, assigns, personal representatives or next of kin, hereby indemnify and hold harmless all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, even if arising from their negligence to the fullest extent permitted by law. 

7. I understand that photography, including flash photography, and videography, and other recordings, will take place at Dance Out Loud: Closer Encounters.  I hereby authorize City in Motion to photograph, videotape, or use any other electronic method of recording my likeness and/or voice to be used at the City in Motion discretion in City in Motion-related publications and/or web sites.  The photographs and/or video footage will not be digitally manipulated to change its content. I give City in Motion the absolute right and permission, to make, copyright, and/or use, re-use, or publish said photographs/video footage of me in which I may be included in whole or in part, and waive any right to inspect and/or approve the finished printed materials, videos and/or web sites where my image appears.  I further consent that my name and identity may be revealed therein or by descriptive text or commentary. I understand that all such recordings, in whatever medium, shall remain the property of City in Motion. I waive any right to compensation for my appearance in these printed documents, videos or websites in any and all future uses of the photographs and/or video footage.

In consideration of attending this event, participate in activities or other programs, or being present at any City In Motion event  – the participant agrees as follows: 

1. I am aware that the novel coronavirus (“COVID-19”) is an extremely contagious virus and that it is currently believed that COVID-19 spreads through person-to-person contact. 

2. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day-to-day, and that the CDC guidelines are regularly modified and updated. I accept full responsibility for familiarizing myself with the most recent updates, and making informed choices to take precautionary measures to protect myself and others. 

3. I will not come to events if I test positive for COVID-19, experience signs of illness related to COVID 19, or have been recently exposed to COVID-19 per CDC Guidelines.

4. In addition to the CDC guidelines, I agree to abide by any and all policies or postings published to the general public related to COVID-19. 

5. I acknowledge that I am aware of the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19, and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others. 

6. I agree that, in the event that I suspect that I became exposed to or infected by COVID-19 while at City In Motion event and I elect to seek testing and/or treatment as a result therefrom, I will be responsible for payment of any and all medical services and testing services that are necessary. 

7. I voluntarily choose to assume all of the foregoing risks and accept sole responsibility for any injury, illness, permanent disability, and/or death related to COVID-19 arising from or in connection with my presence at City In Motion event. I hereby release and hold harmless City In Motion, its subsidiaries, employees, agents, directors, officers and representatives and other participants (“Released Parties”) from and against all liabilities (statutory or otherwise) for claims, suits, demands, judgments, costs, interest and expense (including but not limited to attorney’s fees and disbursements) for injury, illness, permanent disability, and/or death related to COVID-19 arising from or in connection with my presence on at a City In Motion event, even if arising from the negligence, acts, or omissions of the release parties. 

8. If I so desire, I will exercise the individual right to wear a facial mask for personal protection and to reduce possible risk to other people.

I have read this release of liability and assumption of risk agreement, fully understand its terms, and understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.
